If someone doesn't exhibit the fruit of the Spirit, then according to that logic, they don't have the Spirit ! Yet, in Galatians 5, it is possible for someone to still have the Spirit, but choose to walk in the flesh and therefore, not exhibit the fruit of the Spirit.

By their fruit you will recognize them. Do people pick grapes from thornbushes, or figs from thistles? Likewise every good tree bears good fruit, but a bad tree bears bad fruit. A good tree cannot bear bad fruit, and a bad tree cannot bear good fruit. Every tree that does not bear good fruit is cut down and thrown into the fire. Thus, by their fruit you will recognize them.
Psalm 19:14
May the words of my mouth and the meditation of my heart
be pleasing in your sight,
O LORD, my Rock and my Redeemer.
God gives His Spirit to those who obey Him. (Acts 5:32) If your repentance was true, and your old sins were washed away in baptism, He has promised to give you His Spirit. (Acts 2:38). And tongues is still the sign of receiving the Spirit, because God doesn't change.
Thank God for freedom from/of sin!
If we refer to ALL of scripture and not just those verses we want to cling to, then we would know that not everyone gets the gift of tongues, nor does everyone need that gift.
Please use ALL scripture and avoid causing strife among the bretheren.
